Spectrum of Creations dba Food Trends has adopted this privacy policy (this “Policy”) in order to inform you of its policies with respect to the personal information Food Trends collects about you through our interactions with you and through our products, services, events, and programs – including our website located at www.foodtrends.com (the “Website”), and transactions completed at Food Trends physical locations or during deliveries (each a “Service,” and collectively, the “Services”). In this Policy, the terms “Food Trends,” “we,” “our,” and “us” refer to Spectrum of Creations and its wholly owned and operated locations.

By using any of the Services, you consent to the terms of this Policy. Food Trends has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our Site. We encourage Users to periodically check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically to check for any modifications and updates.

Responsibility for information submitted by you

You understand and agree that we are not responsible for the accuracy or completeness of the data you provide to us in connection with the Services.  Accordingly, You represent that you are authorized to provide us with such information for the purpose of your use of the Services and agree to hold us and our subsidiaries, affiliates, officers, directors, and employees, and each of their respective successors and assigns (collectively, the “Indemnified Persons”), harmless from, and indemnify them for all damages, costs, expenses and other liabilities, including reasonable attorneys’ fees and expenses, relating to any claim from any person or entity arising out of or related to your submission of the information provided in accordance with the terms of this Policy.

What personal data we collect

In connection with your interactions with us through our Website, we may collect personal information from you or from other sources, including name, e-mail and other basic information.  This information may be information that you directly provide to us, such as information that you provide when you visit the Website, or information that is passively or automatically collected from you, such as information collected from your browser or device.  The personal information may identify you directly (e.g., your name).  We also collect certain information that does not identify you directly, but in certain circumstances could allow you to be identified indirectly (e.g. certain technical data associated with devices that you use to interact with the Website).

In some instances, Food Trends may also collect information from third-party sources, upon whom we rely to provide and improve our Services.  We use both business partners and service providers, such as payment processors and analytics providers, to perform services on our behalf.  Some of these partners may have access to information about you that we may or may not otherwise have (for example, where you sign up directly with that provider) and may share some or all of this information with us.

In addition to the categories of information referenced above, Food Trends may also collect aggregated data or anonymized data that does not directly identify you.

Use of information

We may use the information we collect from you for various purposes, including, but not limited to:

  • To administer and improve the Services.
  • To allow us to recommend additional Services to you.
  • Communicate with you about your account or transactions.
  • Conduct research and analysis for marketing purposes and advertising campaigns.
  • Personalizing your experience on the Website.
  • Complying with applicable laws and regulations.

Who we share your data with

Food Trends only shares information, including personal information, with its affiliated companies, as well as carefully selected business partners and service providers as part of the provision of our Services to you.  These companies need information about you to perform their service function (such as to process and fulfill your order, verify your credit card information, and to protect you from fraud).  We also share information, including personal information, with specially chosen companies that help us with our internal marketing functions (such as manage our Internet business, maintain and manage our customer information, as well as market our products and services).  We may engage vendors to serve advertisements on our behalf across the Internet and to provide analytics services.  These third parties may collect certain information from you (e.g. click stream information, browser type, time and date, hardware/software information, cookie ID, IP address, etc.) when you visit our Website or Mobile App and use that information to provide advertisements about goods and services that are deemed to be of greater interest to you. Such third-parties may also have their own terms and conditions and privacy policies which you agree to review and by using Services confirm your agreement to such terms. We may utilize alternate or additional third-parties to enable Services to operate, from time to time, in our sole discretion.  By using Services, you consent to such sharing to the extent of the uses here indicated or otherwise permitted by law.

We may also share your information for any other purpose as disclosed at the time of collection, or when we have otherwise obtained your prior consent.

By using the Services and providing any information to us, you are acknowledging that the Services may not be secure and that data transmissions via email, uploads through a network, or on Services forms are inherently insecure. We will not intentionally disclose personal information, but we cannot control and will not be liable for the malicious acts of third parties.  You agree not to provide any information through the Services or email that you or others would not want shared with others.

We may disclose personal information: (1) if we determine a violation of this Policy has occurred; (2) if we believe such disclosure is necessary to identify or bring legal action regarding or prevent injury or interference with our rights or the rights of another user of the Services; (3) to respond to legal process or as otherwise required by law; and (4) to assist us in fraud protection or investigation.

How long we retain your data

We retain your information only for as long as is necessary to provide the Services and to fulfill the transactions you have requested, or for other necessary purposes such as complying with our legal obligations, resolving disputes, enforcing our agreements, or preventing fraud.

What rights you have over your data

If you have an account on this site, or have left comments, or have used the site in any manner, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. In the event you would like to inquire whether we have stored any of your personal information, and/or request deletion of that personal information, please contact us as catering@foodtrends.com

How We Protect Your Information

We do not retain personal information on our company servers but instead utilize commercially available servers through providers such as Amazon Web Services. In the ordinary course of their business, such personal information collected via the Services may be stored and processed in the United States and/or any other country in which that entity responsible for managing our data or the Services maintains facilities.   By using the Services, you consent to any such storage, processing, and transfer of information, about you, into and out of your country, state, and/or territory.

Food Trends takes a number of steps to protect your information from unauthorized access, use, or disclosure.  Food Trends protects your information using technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your information.  Examples of our safeguards include firewalls, data encryption, physical access controls, and administrative informational controls.  When you transmit sensitive information (such as a credit card number) through the Website or in the Mobile App, we encrypt the transmission of that information using the Secure Sockets Layer (SSL) protocol.  No system or network can be guaranteed to be 100% secure.  As a result, we recommend that you help us keep your information safe by taking reasonable steps such as keeping your passwords private, changing them from time to time, and not disclosing personal data in places that can be accessed publicly.

We will not intentionally share your personal information other than as we have disclosed, but we cannot control and will not be liable for the malicious acts of third parties.

We will not have any liability whatsoever for any data breach or unauthorized access to user information collected or submitted through the services.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service and any third-parties we utilize in providing the Service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Food Trends Online, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
